Official contest rules

The HG-Web Contest (the “Contest”) begins at 12:00 a.m. Eastern Time (“ET”) on August 15th, 2021 and ends at 11:59 p.m. ET on August 31st, 2021 (the “Contest Period”).

1. ELIGIBILITY

The Contest is open to all legal entities whose structure (company, business, association, etc.) is legally registered and in operation at the time of their Entry, with the exception of structures legally attached to the HAPIDiT-Group.

2. HOW TO REGISTER AND PARTICIPATE

NO PURCHASE NECESSARY. To enter the Contest, go to the Contest page (the “Website”) and follow the on-screen instructions (the “Entry Form”). Complete all required fields on the Entry Form and:

(i) enter a valid email address, first and last name of company representative, legal status of company, complete mailing address (including postal code), telephone number, activity area and a brief description of business.

ii) confirm that you have read and agree to be legally bound by the terms and conditions of these Rules (the “Rules”); and

iii) like and share the Contest post on social media (Facebook, Twitter, LinkedIn, Instagram);

Once you have completed your Entry Form with all requested information, follow the on-screen instructions to submit (the “Entry”). To be eligible for the Contest, your Entry must be submitted and received during the Contest Period.

All eligible Entries submitted and received during the Contest Period will be included in the prize draw.

Contest Entry Limits and Restrictions

Limit of one (1) Entry per company and per email address during the Contest Period. For the avoidance of doubt, you may only use one (1) email address to enter the Contest. The Contest Website server(s) will be the sole determinant of when an Entry is received.

Verification and Rejection of an Entry

All Entries may be verified at any time and for any reason. The Contest Organizers reserve the right, in their absolute discretion, to require an entrant to provide proof of identity and/or eligibility to participate in the Contest (in a form that the Contest Organizers deem acceptable, such as a legal document issued by a governmental authority for the purpose of administering this Contest in accordance with these Contest Rules). Failure to provide such proof, to the satisfaction of the Contest Organizers in a timely manner, may result in disqualification, in the absolute and sole discretion of the Contest Organizers. If the Contest Organizers discover (through the use of any evidence or information made available to them or otherwise discovered) that an individual:

(i) attempted to obtain more than one (1) Entry during the Contest Period

(ii) has used (or attempted to use) multiple names, identities, email addresses, accounts and/or automated system(s) or programs, macros, scripts, robotic devices or otherwise to participate or to interfere in any way with the proper conduct of this Contest

(iii) has not complied with these Rules; and/or

(iv) has engaged in conduct that is detrimental to the integrity, fairness or administration of the Contest (as determined by the Contest Organizers in their sole discretion), and may, in the sole discretion of the Contest Organizers, be disqualified.

If the identity of an Entrant is disputed, the authorized account holder of the email address submitted at the time of entry will be deemed to be the entrant. Authorized account holder” is defined as the person who has been assigned an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Your Entry will be rejected if, in the absolute discretion of the Contest Organizers, your Entry is incomplete with respect to the information requested or has not been submitted and received during the Contest Period or is otherwise in violation of these Rules. The Released Parties (as defined in these Rules) assume no responsibility for late, lost, misdirected, delayed, incomplete or incompatible Entries. Such Entries are void. The decision of the relevant Parties to reject an Entrant or Entry is final and binding.

3. PRIZE AND VALUE

A total of 13 prizes will be awarded (the “Prizes”). Each Prize includes the creation of one (1) website (the basic module), one (1) donated domain name (.com) for one (1) year and one (1) business email address.

Each prize must be accepted as awarded and may not be transferred, assigned or redeemed for cash (except as expressly permitted by the Contest Organizers in their sole discretion). No prize substitution will be possible, except at the discretion of the Contest Organizers. The Contest Organizers reserve the right, at their sole discretion, to substitute the prize, or a portion thereof, with another prize of equivalent or greater value, including, at the sole discretion of the Contest Organizers, cash. The prize will only be awarded to the legal entity whose full name and valid, verifiable email address is entered in the Entry in question.

N.B. Hosting of the website created is not included in the prize. The hosting of the created website must be subscribed to the company HAPIDiT Group (see pricing here).

4. SELECTION OF WINNERS

On September 7th, 2021 (the “Draw Date”), at HAPIDiT Group‘s office, thirteen (13) eligible entrants will be selected by random draw from all eligible Entries submitted and received during the Contest Period, in accordance with these Rules. Odds of winning depend on the number of eligible Entries submitted and received during the Contest Period in accordance with these Rules.

A designated representative will make at least one (1) attempt to contact the selected entrants (using the information provided on the Entry Form) by email or telephone within seven (7) business days of the Draw Date. If, at the end of the seven (7) business days following the Draw Date, the selected entrants cannot be contacted, or if the notification sent to the selected entrant is returned as undeliverable, the selected entrant will, at the sole discretion of the Contest Organizers, be disqualified (and forfeit all rights to the prize in question). In such event, the Contest Organizers reserve the right, in their sole discretion and if time permits, to randomly select another eligible entrant from the remaining eligible Entries (in which case, the provisions set forth in this section will apply to the newly selected entrant).

BEFORE BEING CONFIRMED AS A PRIZE WINNER, each selected entrant must:

(a) correctly answer, without mechanical or other assistance, a mathematical skill-testing question and ;

(b) sign and return, within seven (7) business days of receiving notification, the Declaration and Release of Liability for the benefit of the Parties (the “Form”), in which (among other things),

(i) confirm that it has complied with this By-law

(ii) signify acceptance of the prize as awarded

(iii) assigns all rights in the Entry Materials; and

(iv) release the Releasees from any and all liability arising from this Contest.

If the selected entrant:

(a) gives an incorrect answer to the skill-testing question,

b) fails to return the completed Form within the prescribed time period

c) is unable to accept (or refuses to accept) the prize as awarded for any reason, and/or

d) is found to be in violation of these Rules (as determined by the Contest Organizers in their sole discretion), he/she will be disqualified (and forfeit the prize) and the Contest Organizers reserve the right, in their sole discretion and time permitting, to randomly select another Eligible Entrant from among the remaining Eligible Entries received (in which case, the provisions of this paragraph will apply to the new selected entrant). Limit of one (1) prize per Participant per corporation.

Each winner consents to the publication, reproduction or other use of his/her name, address, voice, likeness, statements in connection with the Contest and any photograph or other likeness by or on behalf of the Contest Organizers for publicity or other promotional or commercial use by or on behalf of the Contest Organizers in any existing or future media, including print, radio, television and the Internet, without further notice or compensation.

5. GENERAL CONDITIONS

All Entries become the property of the Contest Organizers. The Contest is subject to all applicable federal, provincial and municipal laws and regulations. The decisions of the Contest Organizers are final and binding in all matters relating to this Contest, including any decisions regarding the validity or disqualification of Entries or participants.

By participating in this Contest, you agree to be legally bound by the terms of these Rules. ANY PERSON FOUND TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION AT ANY TIME, AT THE SOLE DISCRETION OF THE CONTEST ORGANIZERS.

The Parties involved and the Third Party Contest service providers and their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Releasees”) will have no liability:

(i) in connection with your Participation in the Contest;

(ii) for any failure of the Website during the Contest

iii) for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer equipment or software

iv) for any fraudulent calls;

(v) for any delay or inability to act resulting from any event or circumstance beyond the control of Releasees including, without limitation, any strike, lockout or other labor dispute

vi) for any Entry not received for any reason, including technical problems or traffic congestion on the Internet or at any Website

vii) for any damage to entrant’s or any third party’s computer or other property resulting from participating in the Contest

viii) the awarding, use or misuse of any Prize, or any portion thereof

ix) prizes that are lost, damaged or misplaced during use; and/or

x) any combination of the above.

The Contest Organizers reserve the right to withdraw, amend or suspend this Contest (or to amend these Contest Rules) in any way, due to error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest (in the sole discretion of the Contest Organizers) is a violation of criminal and civil laws. The Contest Organizers reserve the right to seek remedies and damages to the fullest extent permitted by law.

The Contest Organizers reserve the right to cancel, modify or suspend this Contest, or to amend these Contest Rules in any way, in the event of technical problems, printing errors, clerical errors or any other errors whatsoever, or for any other reason, without prior notice or obligation. Without limiting the generality of the foregoing, the Contest Organizers reserve the right, in their sole discretion, to hold another contest, if they deem it appropriate, depending on the circumstances and/or in order to comply with applicable law.

The Contest Organizers reserve the right, in their sole and absolute discretion, to modify, without notice, the Contest schedule or any of the dates indicated in these Contest Rules, when necessary, in order to verify the compliance of any entrant or Entry with these Contest Rules, or due to technical problems or any other circumstance that, in the opinion of the Contest Organizers and at their sole discretion, may affect the proper administration of the Contest in accordance with these Contest Rules, or for any other reason.

Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Court of First Instance of Quebec (for participants from the Americas and Europe) or the Court of First Instance of Antananarivo (for participants from elsewhere). Any litigation respecting the awarding of a prize may be submitted to such courts only for the purpose of helping the parties reach a settlement.

By entering this Contest, each entrant authorizes the Contest Organizers and their agents and/or representatives to retain, share and use the personal information provided by the entrant on the Entry Form for the purposes of administering the Contest and awarding the Prize, including, without limitation, communicating with the entrant about the Contest and his/her entry. You may also receive additional communications from HAPIDiT Group and/or third party partners (as the case may be) about their products, services, upcoming contests and promotional offers upon your participation in the Contest. You may at any time during or after the Contest waive the consent you have given to receive additional communications by following the unsubscribe instructions available in such communications or by sending an unsubscribe request to contact@hapiditgroup.co.

These Contest Rules may be viewed on the HAPIDiT Group website no later than fifteen (15) days following the Draw Date.

In the event of a discrepancy or inconsistency between the terms and conditions of these Contest Rules in the French version and the statements or other declarations contained in the Contest documents, including the Entry Form, the Website, the English version of these Contest Rules and/or point-of-sale, television, print or online advertising material, the terms and conditions of the French version of these Contest Rules will prevail to the extent permitted by law.
